Unfortunately, a disclaimer is essentially useless. You still have 'duty of care' and can still be sued for not ensuring that every possible effort was undertaken to avoid the injury. Unless you can prove otherwise, you're liable and will get your back doors beaten in by the court.

I would disagree with that slightly. Yes it's true that you can't exclude liability for negligence and an instructor has a duty of care to his students (as does each student to each other), it is however useful as a means of putting people on notice that's a contact sport with risk of injury and recording their consent accordingly.
